Data Protection & Privacy - The Upcoming Framework Governing the Protection of Personal Data (GDPR) Challenges and how to strike the right balance

The new EU data protection regulation – commonly referred to as the “GDPR” – will enter into effect on May 25, 2018. The aim of this new framework is to adapt data protection law in accordance with the technological evolution that took place over the past 20 years. Switzerland is following the EU path with a new draft law. The new rules mean more obligations for data controllers, empowerment of data subjects and additional powers granted to authorities.

Against this background, our presentation will address questions and concerns of tech ventures in this new framework, be they Startups, Tech companies or academic research projects. In particular, we will focus on the 3 following aspects:

(1) GDPR and impact for tech ventures: Changes to be taken into account? Impact for tech ventures (startups, scientific projects)? Type of data that can be collected?

(2) Specificities of research projects: Collection and use of data for research purposes. Where is the right balance between the interests of data subjects, the freedom to innovate and the needs to tech ventures to be able to collect and use such data?

(3) Contracts and policies: How contracts and policies need to reflect that the new framework has been taken into account.
